These Terms and Conditions (“Terms”) apply to all sales of machinery, vehicles, equipment, attachments, parts, and related goods (“Goods”) supplied by Beckside Machinery Limited, trading as Beckside Machinery (“Seller”). By placing an order, the Buyer agrees to be bound by these Terms and Conditions.
These Terms apply to both consumer and business buyers. Where applicable, the statutory rights of consumers will take precedence.

2. Definitions
2.1 “Seller” means Beckside Machinery Limited.
2.2 “Buyer” means any individual or business purchasing Goods from the Seller.
2.3 “Goods” means any machinery, vehicles, equipment, attachments, or parts supplied by the Seller.
2.4 “Contract” means the agreement formed between the Seller and the Buyer in accordance with these Terms.
3. Application of Terms
3.1 These Terms apply to all sales of Goods unless varied in writing by an authorised representative of the Seller.
3.2 Any other terms proposed by the Buyer are excluded unless expressly accepted in writing.
3.3 Website descriptions, brochures, and advertising materials are for general guidance only and do not form part of the Contract unless confirmed in writing.
4. Orders and Acceptance
4.1 Quotations are valid for 30 days unless stated otherwise.
4.2 A Contract is formed when the Seller issues written confirmation of the order or issues an invoice.
4.3 The Seller reserves the right to decline an order at its discretion.
5. Prices and Payment
5.1 Prices are exclusive of VAT unless otherwise stated.
5.2 A non-refundable deposit may be required to secure an order.
5.3 Payment must be made in cleared funds before collection or delivery unless otherwise agreed in writing.
5.4 Accepted payment methods include bank transfer, card payment, or approved finance arrangements.
5.5 For business customers, interest may be applied to late payments in accordance with the Late Payment of Commercial Debts (Interest) Act 1998.
6. Retention of Title and Risk
6.1 Title to the Goods remains with the Seller until the Seller has received payment in full.
6.2 Risk in the Goods passes to the Buyer upon delivery or collection, whichever occurs first.
6.3 Until title passes, the Buyer must store the Goods securely and keep them identifiable as the Seller’s property.
6.4 In the event of non-payment, the Seller may recover the Goods.
7. Delivery and Collection
7.1 Delivery dates provided by the Seller are indicative and not guaranteed.
7.2 Delivery charges are payable by the Buyer unless agreed otherwise.
7.3 The Buyer must inspect the Goods upon delivery or collection and notify the Seller within 5 working days of any visible defects or discrepancies.
7.4 If the Buyer fails to take delivery, provide access, or provide adequate unloading arrangements, additional costs may be charged.
8. Condition of Goods
8.1 New Goods
8.1.1 New Goods are supplied with a manufacturer’s warranty, the duration and terms of which vary by manufacturer.
8.1.2 Warranty claims relating to new Goods must be submitted in accordance with the manufacturer’s procedures.
8.2 Used Goods and Used Vehicles
8.2.1 Used Goods are supplied in used condition and may display signs of wear or previous use.
8.2.2 The Seller provides a one-month warranty covering major mechanical and structural faults unless otherwise stated in writing.
8.2.3 The warranty for used Goods does not cover:
• consumables (including tyres, belts, filters, fluids, batteries);
• cosmetic wear or minor defects;
• faults arising from misuse, improper operation, or insufficient maintenance.
8.3 Inspection
8.3.1 Buyers are encouraged to inspect Goods prior to purchase.
8.3.2 If the Buyer chooses not to inspect the Goods, this does not create any additional rights after delivery.
8.4 Consumer Rights
8.4.1 Nothing in these Terms affects the statutory rights of consumers under the Consumer Rights Act 2015.
9. Warranty Claims and Returns
9.1 Business Buyers
9.1.1 Returns or cancellations by business buyers are not accepted unless agreed in writing by the Seller.
9.1.2 Where a return is accepted, restocking or handling charges may apply. The seller may charge up to 25% of the order value in applicable charges.
9.2 Consumer Buyers
9.2.1 If Goods are faulty, consumers may have rights to a repair, replacement, or refund in line with the Consumer Rights Act 2015.
9.2.2 These rights apply in addition to the manufacturer’s warranty (for new Goods) and the one-month used Goods warranty.
9.2.3 Where a return is accepted, restocking or handling charges may apply. The seller may charge up to 25% of the order value in applicable charges.
9.3 Exclusions
The Seller is not responsible for faults resulting from:
a) misuse or improper operation;
b) insufficient maintenance;
c) accidental damage;
d) unauthorised repairs or modifications.
10. Buyer Responsibilities
10.1 The Buyer is responsible for ensuring that:
a) machinery is operated by suitably trained and competent personnel;
b) all relevant safety procedures are followed;
c) maintenance is carried out in accordance with manufacturer recommendations.
10.2 The Buyer indemnifies the Seller against claims arising from unsafe or improper operation of the Goods.
11. Cancellation
11.1 Consumers
11.1.1 Consumers purchasing at a distance may have rights to cancel under the Consumer Contracts Regulations 2013.
11.1.2 These rights do not apply to:
• customised or made-to-order Goods;
• Goods that have been used;
• machinery that has been assembled or operated by the Buyer.
11.2 Business Buyers
11.2.1 Business buyers do not have cancellation rights unless expressly agreed in writing.
12. Force Majeure
The Seller is not liable for delays or failure to perform obligations due to events outside its reasonable control, including severe weather, transportation issues, industrial action, supply chain disruption, or government restrictions.
13. Governing Law and Jurisdiction
These Terms and the Contract are governed by the laws of England and Wales. All disputes shall be subject to the exclusive jurisdiction of the English courts.
14. Entire Agreement
These Terms, together with the Seller’s written order confirmation, constitute the entire agreement between the parties and replace all prior agreements, understandings, or representations.
