Terms And Conditions

1. Format of the Contract
1.1. Scope: These terms govern all sales by Beckside Machinery Ltd, registered at Beckside Farm, Caistor Road, Osgodby, Market Rasen, LN8 3SY.
1.2. Ordering: Your order through our website constitutes an offer to buy the goods. A contract is formed only when we accept your offer, at our discretion.
1.3. Acknowledgement: After placing your order, you will receive an acknowledgement email. This is not an acceptance of your order.
1.4. Acceptance: We will confirm acceptance by email before dispatching the goods. If we cannot supply the goods, we will inform you via phone or email.
1.5. Unavailable Goods: After accepting your order, if we find the goods are unavailable or there was a pricing error, we reserve the right to not supply the goods, offering instead a refund or alternative goods as detailed in sections 2.2 to 2.4.
1.6. Cancellation Rights: The contract includes your right to cancel as per section 7.
1.7. Non-payment Termination: The contract can be terminated if payment is not received in full.
1.8. Amendments: We may change these terms for future sales without notice.

2. Description and Price of the Goods
2.1. Product Details: The goods are as described and priced on our website when you place your order.
2.2. Post-Acceptance Unavailability: If goods become unavailable within 14 days of our acceptance, we may end the contract and refund any payments made within 7 working days.
2.3. Partial Unavailability: If only some goods are unavailable, we will inform you and offer options to cancel or amend your order. If the order is not cancelled within 14 days, we will proceed with the available goods.
2.4. Pricing Errors: Should a pricing error be discovered, we will offer you the option to re-order at the correct price, cancel the order, or amend it for the correctly priced goods. Inaction within 7 days leads to automatic cancellation or adjustment as appropriate.
2.5. Subsequent Orders: Orders for alternative or corrected-price goods fall under these terms.
2.6. Delivery Charges: Additional charges for delivery are specified at the order stage, except for collection-only items.

3. Payment
3.1. Payment Terms: Payment is due before delivery and is a fundamental agreement term. Non-compliance allows us to terminate the contract.
3.2. Delivery upon Payment: Goods will not be delivered until payment is cleared, except where credit facilities are agreed for business accounts.
3.3. Deductions: Payments must be made in full unless a court order justifies a deduction.

4. Delivery
4.1. Delivery Address: Goods will be delivered to the UK address provided with your order.
4.2. Delivery Effort: We aim to deliver promptly but are not liable for delays. You will be informed of any significant delays.
4.3. Receipt of Goods: You must sign for goods in good condition or mark as UNCHECKED if unable to immediately inspect.
4.4. Non-faulty Returns: Returns not due to fault or misdescription incur delivery charges.

5. Risk/Title
5.1. Risk Transfer: Risk passes to you on delivery.
5.2. Title Transfer: Ownership passes once we receive full payment for the goods and any other due amounts.

6. Title for Business Customers
6.1. Storage and Identification: Until ownership passes, goods must be stored separately and identifiable as our property.
6.2. Insolvency or Business Changes: Your right to possession ends if you face insolvency events.

7. Your Right of Cancellation
7.1. Cancellation Period: You can cancel within 7 days of receiving the goods.
7.2. Cancellation Process: Written notice is required for cancellation. Phone cancellation is not accepted.
7.3. Return Costs: Except for faulty goods, you bear the cost of returning goods.
7.4. Refund Policy: Upon cancellation, refunds are processed within 30 days.
7.5. Non-return Charges: Failure to return goods allows us to charge for recovery costs.
7.6. Exclusions: Cancellation rights do not apply to unsealed software or non-returnable consumables.
7.7. Cancellation Charges: Cancellation of built/completed items before and after dispatch incurs a 15% charge.
7.8. Delivery Charge Obligations: Cancellation does not waive delivery charges.

8.1. Used Goods: Used goods are identified on our website and warrantied for 30 days unless sold "as seen."
